In 2015, the Supreme Court Case Obergefell V Hodges legalized same-sex marriage nationwide. Since then, the court case has remained uncontested—that is, until August 2025, when Kim Davis petitioned the Supreme Court to revisit and overrule the case. Kim Davis, a strict conservative who infamously refused to issue marriage licenses to same-sex couples, claims that Obergefell V Hodges is unconstitutional because same-sex marriage goes against her religious beliefs, therefore violating her right to religion in the United States. Her claims have been refuted by the Supreme Court once before—in 2019, she tried petitioning the Supreme Court to overrule Obergefell V Hodges, but the lower courts dismissed her claims before she managed to make it to the Supreme Court. As of right now, the chances of Obergefell V Hodges truly being overturned are slim, but until Kim Davis’ petition is ruled by the courts, we do not know what will happen.
